The 65th U.N. General Assembly on Multilateral Disarmament Treaty

September 29, 2010

By Padmini Arhant

On September 24, 2010, the United Nations held a “High-level Meeting on Revitalizing Disarmament Conference” attended by 65 nations’ dignitaries in Geneva, Switzerland.

The Conference objectives were to initiate discussions on the –

Biological and Chemical weapons,

The Comprehensive Nuclear Test-Ban Treaty (CTBT) and,

The Non-Proliferation Treaty (NPT) including,

START – Treaty on the Reduction and Limitation of Strategic Offensive Arms,

PAROS – Prevention of Arms Race in Outer Space and,

Last but not the least – Nuclear States threats against non-nuclear nations.

Although the statements from these organizations’ representatives and U.N. members defined the international community role and the urgency to begin nuclear non-proliferation and disarmament discourse, the session ended in an impasse.

The reason behind the unsuccessful outcome is attributed to the Multifaceted Treaty’s one aspect and that being,

The FMCT – Fissile Material Cut-Off Treaty reportedly blocked by Nuclear Pakistan insisting on the Fissile Material Treaty fairness and effectiveness on the whole, an identical position shared with its Nuclear neighbor India.

The fissile material related to the plutonium and uranium enrichment for nuclear weapons capability is crucial in the disarmament dialogue to implement a Comprehensive Nuclear Test Ban Treaty.

In fact, Pakistan’s position in this regard is absolutely legitimate and worth examining.

Pakistan’s claim that FMT mandate be internationally incorporated and multilaterally verified to accommodate the majority nuclear and non-nuclear states’ national security concerns comparable to “equal security for all,” principles is in direct alignment with India’s request.

India has raised the legitimacy and credibility factor surrounding all treaties i.e.

Non-Proliferation, Nuclear disarmament focused on FMT, PAROS, START and negative security assurances for they are all at present severely lacking in accountability and transparency among the NPT-5,

The U.S and Russia in particular as the pioneers currently in possession of over 95 percent world’s nuclear arsenal.

Poignantly, the very first nuclear disarmament and permanent ban on nuclear testing was set forth by the First Indian Prime Minister Jawaharlal Nehru in 1954 – the nuclear era with conspicuous disdain for nuclear ban proposals that is evidently prevalent until now into the twenty first century.

Subsequently, India remained persistent and called for an international convention in 1978 prohibiting the nuclear weapons use or threats against any nation followed by,

A daring initiative in 1982 submitting to the United Nations – a “Nuclear Freeze,” on fissile material production facilitating nuclear weapons and related delivery systems.

Further, in 1998 India put forward an Action Plan comprising phased elimination for all nuclear weapons and WMD within a specified timeframe setting the cornerstone in the nuclear doctrine.

None of the nuclear weapon states with far more nuclear potential responded to the cause then or for that matter now in the CD conference.

Pakistan and India share the sentiments in the non-cooperation and disingenuous display by the real players the NPT-5 with a burden of responsibility to exemplify their verbal commitments through actions that is being demonstrably evaded as the privileged Security Council members.

All the more reason for the imperativeness to expand the U.N. Security Council permanent membership with broad representation by nations such as Japan, Brazil, India, South Africa, Germany, Norway, Turkey and UAE besides the extensive diversification called for in the recent CD Summit only to be ignored denying global interest.

Had the powerful nuclear weapon states engaged in earnest participation with appropriate and definitive content mutually agreeable to third party verification in the nuclear treaty throughout the twentieth and twenty first century, the world would not be dealing with nuclear proliferation or terrorism.

Even the new START agreement between U.S and Russia signed in 2010 is subjective to ambivalence on both sides based on past experience specifically –

The exchanges with Kremlin during the former President Ronald Reagan START introduction referred to as SALT III at that time and evaluated by the American arms control advocates as;

“A deceptively equal-looking, deliberately nonnegotiable proposal that is part of what some suspect is the hardliners’ secret agenda of sabotaging disarmament so that the U.S. can get on with the business of rearmament.”

Similarly, the then Soviet Union had not disclosed the ICBM (Inter Continental Ballistic Missiles) data accurately in the submission.

Such inconclusiveness in the international security matter since the nuclear age precipitated the nuclear and conventional arms race to an unprecedented and unsustainable level.

The repetitive failed attempt to invigorate meaningful disarmament talks is a cliché in the contentious yet easily resolvable issue.

Moreover, the notion that U.S, Russia, China… are responsible nuclear states while disqualifying others from the league is a misnomer considering the status quo and proved detrimental to the nuclear deterrent policy for it encouraged defiance against compliance.

The unanimous frustration and disappointment among the non-elite nuclear states and the vulnerable non-nuclear NPT nations leads to a concrete decision in enforcing;

The universal CTBT – Comprehensive Test Ban Treaty ‘entry into force’ rule effective immediately beginning at the fissile material ban targeting both supply and production in the present and the future.

Pursuant to NPT article VI, CTBT entry by force would have a profound impact on the NPT obligations binding the NPT and non-NPT nuclear states along with non-nuclear NPT countries.

Forced entry CTBT statute would reveal the observance or the lack there of by the respective nuclear and non-nuclear States.

It would also determine the Treaty viability and the multilateral apparatus adherence to NPT apart from restricting the sophisticated nuclear weapon upgrade or new development by any or all.

A worldwide Monitoring System and a neutral committee dedicated to NPT and WMD elimination would concurrently phase out the nuclear weapon prospects and systematically retrieve the stockpiles from all parties commencing with the major stock holders i.e. United States, Russia, France, U.K. China and others.

The grievances expressed by the scapegoats earlier India and now Pakistan in the CD failure,

Arguably found in the consistent setbacks on all treaties pertaining to conventional, WMD and nuclear weapons suggesting the so-called summits frame work designed to weaken rather than strengthen the nuclear disarmament and non-proliferation institutional policies aimed at the regional and international peace and security.

Given the facts on the ground with the relentless and widespread violence through warfare, the agenda do not match the false exhibits in the previous summits.

Therefore, the United Nations General Assembly members consolidated commitment to global peace and security could be made possible by –

Forging the U.N. Security Council permanent membership expansion and,

Implementing the CTBT to accomplish the non-violation and irreversible NPT complemented by strategic and general weapons substantive and complete disarmament.

The U.N. members at the general assembly could essentially review and restructure the umbrella organization policies to conform to the twenty first century in every respect.

Non-nuclear NPT and nuclear states have a unique opportunity to change the dynamics with a paradigm shift by being inclusive not exclusive in the nuclear negotiations eventually resulting in pervasive nuclear disarmament.

The ICBL (the International Campaign to Ban Landmines) treaty is also vital in the disarmament process with certain key powers not having ratified the protocol despite the staggering toll on the children and economically disadvantaged population across the globe.

Again, the collective pledge to safeguard life and the planet is guaranteed to produce the desirable result –

A peaceful, prosperous and unified world.

Good Luck and Best Wishes to the United Nations and nexus organizations for phenomenal success in the humanitarian goals.

Thank you.

XIX Commonwealth Games 2010 – New Delhi, India

September 23, 2010

By Padmini Arhant

The delay in preparedness and various issues concerning the games village has justifiably placed the CWG authorities in spotlight. Being an international event the expectations in the readiness for the athletes arrival is fair and considering the organizers’ miserable failure the reaction is normal.

Although the village complex should have been made available in top notch condition months ago, the torrential rain causing the Yamuna River flooding exacerbated the situation.

Nevertheless, the status quo could be turned around to the international standard despite the pessimism, criticism and the time factor.

For a nation with an incredible talent and human capital, a renowned technology hub, the phenomenal output from the motion picture industry and above all the September 2009 rewarding lunar mission leading to the water detection in the moon, the CWG village restoration should be a no brainer.

It’s clear the committee behind construction and organization needs to be replaced immediately by a nationally or internationally acclaimed robust private industry with expertise in crisis management and sensitivity to the related multinational games.

Most importantly, eliminating bureaucracy that could have partially contributed to the existing problem and diverting attention to the surrounding issues with a positive result is paramount.

Perhaps, the crew hired for the airport project –‘Indira Gandhi International Airport Terminal 3’ that not only produced an exemplary work but also reportedly completed the task within budget and delivered prior to the deadline would be appropriate since they were engaged earlier for the CWG purpose.

It’s incumbent upon everyone across the nation to aid in the CWG rescue rather than allowing the scheduled activity to fall apart.

As for the security issue, the threats during any international occasion are not uncommon – from Olympics to G-20 summits the terror warnings are floated in to discourage the sports or meeting occurrence. When heeding to fear mongering the terrorists and their agenda prevail over rationality and solidarity.

Ensuring tight security around the CWG site again by the competent security agencies – government forces along with trusted local private security firms should adequately provide the necessary protection all over the city.

The technology could be extensively used to thwart any attempts by installing ‘CCTV cameras with audio’ all around to enable further assistance in this regard. Citizens cooperation would enhance the efforts.

It’s important to realize that New Delhi has hosted many successful international events prominently the 1st Asian Games back in March 4 – March 11, 1951 and later the IX Asian Games in 1982 when the Asian Games Village was uniquely designed by the leading architect Raj Rewal who recently completed the much admired Indian Parliament library in New Delhi – attracting accolades.

Per Architecture Week: Specializing in Architecture Design and Building

“The recently completed Parliament Library in New Delhi, India is a response to its monumental context and yet ingenious in its originality.

Designed by architect Raj Rewal, the library is a fine example of post-colonial Indian architecture. It displays high technology with a regional expression, it is modern yet rooted in precolonial history, and it responds thoughtfully to its challenging colonial and political context.”

In addition to sports events, New Delhi has been the popular venue for International Trade Expositions and Symposiums housing delegates and participants from all corners of the world.

Similarly in other parts of India, the Hyderabad Asian-Africa Games in 2003 was proved a remarkable achievement.

India – the land of magnificent palaces, temples and historic monuments is most famous for “The beautiful Taj Mahal,” – all serving as an unparalleled architectural marvel and sculptural feast for the eyes since time immemorial.

Therefore, the CWG facilities across the spectrum should have exceeded the national and international evaluations.

Nonetheless, the athletes accommodation and the venue could be upgraded or relocated to a desirable ambiance in the city through private intervention rather than local government involvement.

Besides, the investments are at stake notwithstanding the national image and reputation.

There is no time to procrastinate and India in the twenty first century cannot resign to ‘not doable,’ approach but instead demonstrate collective responsibility in proving that,

Where there is a will there is a way.

Actions carried out in true human spirit and national interest is bound to triumph the trials and tribulations.

Commonwealth games must proceed to fulfill the humanitarian commitment through sports with utmost diligence assuring the athletes as well as the residents comfort, safety and security.

Thank you.

New Developments in India

August 22, 2010

BY Padmini Arhant

Per the article International Events – India Independence Day published on this website 08/16/10 under International Politics, the food prices inflation impacting the incumbent administration in New Delhi at national polls was cited in the post.

Further, the scenarios causing the food inflation was elaborated with solutions to overcome the situation contributing to the Prime Minister Man Mohan Singh’s decline in the national polls among the frustrated population.

Upon the private media investigation in the matter, the latest findings reveal that the suspicion on the illicit trade practices involving government subsidized staple food reserved for domestic consumption is confirmed to be factual.

For rice is being smuggled out of the state and exported overseas to Singapore, Malaysia and New Zealand…at 1000 percent profit.

As a result, the consistent demand is superficially inflated with short supply depriving the local population of the Central government subsidies.

In this context, the southern state of Tamil Nadu government under the Chief Minister M. Karunanidhi, is implicated in the video documentary of the trade activity from origin to destination.

Reportedly, the state agricultural minister has refused to comment despite the facts surrounding the nationally exposed food scandal.

Besides, the Chief Minister M. Karunanidhi’s victory was premised on supplying rice to the poor and the lower income at one Indian rupee.

The Central government apparently provided the stock for distribution at that price, evidently the state officials diverted the stock for profitable means.

The Congress party as the Central authority is in a dilemma with the Tamil Nadu government being one of the coalition partners enabling the majority rule to govern the nation.

Regardless, the Congress party is obligatory to the nation in cracking down on corruption and honoring the campaign promise in transparency and accountability especially with the scandal emanating from within the coalition.

It would remarkably improve the Congress party’s image, credibility and future electoral prospects through effective actions in dealing with the systemic abuse of power at various political levels beginning with corruption undermining democracy.

Not to mention in addressing the public anxiety over the Central power’s inability to control artificial food inflation.

Worldwide, politics without corruption and power abuse is a misnomer. It’s attributed to populace disappointment not transformed into action in eliminating corruption from the base.

Tamil Nadu has been ruled by two political factions for decades, each periodically replaced by one another for similar or distinctive dysfunctionality.

The state is renowned for intellectual feat in science and technology, cultural arts and humanities.

However, Politics has not been easily accessible to the talented mainstream due to the dominance by the state’s motion picture industry artists.

Perhaps, the Tamil Nadu electorate could reflect on the establishments’ record obstructing the state’s progress and elect intellectually poised leaders committed to the electorates’ interest rather than their own. They could be young, mature and energetic or the experienced seniors dedicated to serving the people and not the personal agenda.

Nevertheless, a breath of fresh air is always better for the contaminated political environment.

It’s analogous to global politics.

In other issues raised in that article – the new development from the Naxal and Maoist groups extending an olive branch is extremely hopeful and it would be appropriate to end the standoff with mutual ceasefire from both sides enhanced by a new commitment to peacefully resolve the long standing dispute.

Since the Naxal and Maoist group’s choice of mediators are arousing unnecessary political tensions, it would serve the peace process positively with the independent panel unaffiliated to both parties but well adapted in delivering the desirable outcome i.e. listening to the insurgents’ issues and making an effort in understanding the reasons behind their struggle is an initial step towards reconciliation process.

At the same time, offering the reasonable and realistic solutions to the problems would be an amicable approach to the successful negotiation.

Maintaining similar strategy in other national security and economic issues related to farmers is favorable to all sides.

Good luck! To all members in the peaceful settlement of political, economic and social issues.

Thank you.

International Events – India Independence Day

August 16, 2010

By Padmini Arhant

Happy Independence Day to India on August 15, 2010.

India celebrated its 63rd anniversary amid stability and domestic crisis.

On the economic front, India is focused on GDP growth but struggling to contain food prices.

The inflation is contributing to the public anger and disappointment reflected in the national polls directed at the Central government.

Adding to the problem is the recent handling of the farmers’ plight in the northern state of Uttar Pradesh. The State government’s slow response to the situation is criticized nonetheless; the damage control measures are being implemented possibly with the Central government intervention if required.

While being steadily progressive, the Indian economy has been challenged with inflation in some areas like food that is demanding immediate attention from both the public and private sector.

The government authorities, i.e. the Agricultural Ministry is under lot of pressure to act effectively in controlling the rising inflation.

Although, India is known to be fairly self-sufficient in staple food and other produces, the price surge could be attributed to natural and superficial factors. The nation has been dealing with extreme drought and floods in different parts of the country lately exacerbating the farmers’ uphill battle against the economic woes surrounding a good harvest.

Alternatively, the supply could be restricted by the various merchant groups involved in the distribution right down to the government authorized ration shops diverting the stock for private sale influencing the market rate. It’s not uncommon and the artificial price hikes surface during consistent demand superficially escalated with the short supply.

Further, cash crop exports to promote GDP could be halted and instead used for domestic consumption until the affordable market price is restored.

Perhaps, the government and private investigation into such practices could ease the burden on the economy, the farmers and the consumers. It would also help if the State and the Central governments address the farmers’ various agricultural issues to improve production.

National Security – The Indian government is confronted with security threats within the national territory mainly instigated by external forces.

The Naxalite and Maoist Groups with communist ideology have remained in opposition to the democratic Central and state governments regardless of political factions.

At present the tension is compounded with the new evidence reportedly involving the Pakistani ISI and Pakistan sheltered fugitive – the underworld don Dawood Ibrahim hiring the naxals to wage proxy war against the Indian security force.

Neighboring nuclear nations’ incited insurgency in the world’s largest democracy is an unnecessary provocation and deserves global condemnation.

While one is portrayed as the ‘ally’ in the war on terror and the other a ‘reliable,’ economic partner, the reality being neither appear to be committed in the respective domains,

For, the terror masterminds especially Osama Bin Laden and other chief militants are at large and yet to be revealed from the undisclosed locations in Pakistan,

The currency adjustments against the U.S. dollar by China still remains a contentious issue despite China’s assurance in adhering to the U.S. and international request at the Toronto G-20 summit.

Meanwhile, the Indian Government’s best strategy would be to initiate a dialogue with the insurgents i.e. the Naxalites and,

If the grievances are economic and social disparities related, then those anomalies could be appropriately fixed by providing the necessary means to the segments including minority representation in the parliament.

Concurrently, freezing the proxy war agents’ bank accounts and financial channels,

In addition to, tracing and terminating the rebels’ ammunition origin would deter the uprising and encourage peaceful negotiations.

The other matter pertains to Pakistan based militant group – Lashkar-e-Taiba instigated separatist movement in Kashmir.

Upon the State Chief Minister Omar Abdullah, the Prime Minister Man Mohan Singh including the cabinet ministers’ review of the secessionist proposal and call for peace in the valley with sincere offers to reconcile the differences, there was glimmering hope for amicable settlement in Kashmir.

However, the militants across the border aided by the terror groups and the Pakistan intelligence agency,

Ever determined to sabotage the Muslim population peaceful existence ignited a renewed unrest leading to loss of lives and curfew imposition in Kashmir.

It proves that the institution like a national intelligence agency traditionally responsible to defend and protect civilians from harm are unfortunately dedicated to counterproductive activities claiming innocent Muslim lives at their domicile and in the neighboring state.

Ironically, the Muslim population is attacked and killed more in Pakistan than anywhere else by the same terror groups that are behind the separatist movement misleading them for an independent state in Kashmir.

A persistent and persuasive peace talk is an ideal approach for the Indian leaderships in resolving the political and social disputes. It is guaranteed to provide a positive outcome.

Avoiding firearms and excessive tactics against unarmed civilians in any circumstances is favorable to all sides.

In other areas of interest –

Investments in green technology and robust environmental policy are crucial to protect the planet.

India could lead in the renewable energy use by adapting to natural sources rather than fossil fuel or nuclear resource. Given the suitable weather conditions, India would highly benefit in providing cost effective energy programs to all.

Alleviating the suffering in hunger, poverty and disease among the vast majority would enhance development.

Completing infrastructure projects within time frame is better for business opportunities and national image.

Otherwise, India’s achievements since independence is exemplified in the status quo as an emerging economy, thriving secular democracy, innovator in science and technology and a cultural phenomenon to say the least.

Best Wishes to the Republic of India for a long lasting peace, eternal progress and prosperity.

Thank you.

International Events – Pakistan Independence Day

August 15, 2010

By Padmini Arhant

Happy Independence Day on August 14, 2010 to Pakistan!

Pakistan celebrated its 63rd anniversary since partition from India and the nation has been confronted with humongous challenges until now.

The recent flooding has taken a toll on the population and the victims’ frustration is directed at the authorities engaged in rescue operation.

The United States assistance and the generous contributions from people around the world are significant in saving lives.

Pakistan is also politically and economically undermined by the various terror networks wreaking havoc within and outside the country.

More than six decades into independence and Pakistan is deprived of a vibrant democracy predominantly due to the liaison maintained by the key officials in the Pakistan military along with ISI, the intelligence agency with the militants and radical groups like Taliban, Lashkar-e-Taiba, the Haqqani networks, the underworld don viz. Dawood Ibrahim Kaskar and the likes.

Why is Pakistan so tolerant and providing refuge to these criminal elements despite their notoriety are the legitimate concerns in the international community?

One would presume that the substantial U.S. military and financial aid to Pakistan to clamp down on terrorism should have eliminated terror from the nuclear nation.

Instead, the terror organizations prominently the Al-Qaida, Taliban, the Haqqani and Lashkar-e-Taiba have transformed Pakistan into a terror haven killing more Pakistanis, their fellow Muslims in the endless explosions across the country.

Besides, them instigating violence in neighboring Kashmir and consistently plotting against the United States as well as other democracies around the world.

How can they possibly justify these actions in the name of Almighty God, the Allah and the Holy Quran that forbids any harm to the living in any shape or form?

Can these individuals be regarded Muslims considering their indiscriminate violence towards fellow human beings particularly their own Muslim brothers and sisters, whether in the United States, India, United Kingdom, Saudi Arabia, or for that matter the incessant bombings that are occurring in Pakistan?

It’s no secret that the certain Pakistani military and ISI members ‘aiding and abetting has emboldened the terror networks and enabled them to freely operate in the nuclear armed nation.

What is the solution to this radicalization and how can it be addressed effectively?

Arms embargo in addition to freezing bank accounts facilitating terror activities within Pakistan is paramount in ensuring global security.

The Pakistani educated youth and the middle class have a responsibility to take control of their nation.

For, it’s their future that is being squandered by the unscrupulous sources in the national defense and intelligence agency.

Pakistan has enough military power to have contained if not eradicated terror, considering the successful military coups against democratic governments since its birth.

Then, why the combined forces of Pakistan and U.S. military are having difficulty demolishing the medieval terror infrastructure in the twenty first century is mind boggling.

As a result, the Pakistani citizens and the U.S. taxpayers are forced to bear the brunt in human casualties and the economic aspect.

How long should these war games continue and at what cost?

These are the questions to be raised by the people of Pakistan and the United States.

Human lives are expended on both sides with no end in sight to the war on terror.

Throughout history, the people have demonstrated the will and courage to stand up to the forces stalling human progress.

Evidently, they have triumphed from time and time again.

Therefore, Pakistan’s public complacency to the decadent status quo from the myriad sources dominance is the problem and could be easily resolved through solidarity by identifying the ‘bad apples,’ and replacing them with those dedicated in renewing Pakistan’s image as a friendly neighbor, viable economic partner and a true ally in the global war on terror.

There is an opportunity for a new chapter in the twenty first century provided the people initiate the peaceful beginning.

‘Change,’ cannot be brought upon by mere hope, it has to be delivered through action.

Best Wishes to the people of Pakistan in achieving peace, progress and prosperity.

Thank you.

Peace in Kashmir Valley – Truce between India and Pakistan

August 3, 2010

By Padmini Arhant

The Indian State of Kashmir is under curfew due to the escalating clashes between the militants’ proxies and the Indian Security forces.

Reportedly somewhere between nine and thirty three people had died, several security personnel got injured in the past three days alerting a cabinet committee review among the Central and State government leaders. The cabinet meeting presided by the Indian Prime Minister Man Mohan Singh appear to have discussed the pertinent issues on Kashmir.

Views on the Kashmir valley vary depending on the beholder.

Kashmir is the long disputed territory for the nuclear neighbors Pakistan and India since their independence. The misguided approach to the Kashmir dispute has stalled the strong bilateral relationship from fruition. Both countries that were once united in the Indian sub-continent share more similarities on a broad spectrum.

The multifold opportunities at political, economic and social front could benefit both countries enormously by divesting the disproportionate defense spending to improve the lives of the vast majority living in abject poverty and concurrently promoting the society’s educated middle class that has been instrumental in driving the respective work force.

Instead, the nations have engaged in conventional warfare and were at the brink of nuclear confrontation not long ago contributing to the lingering security concerns on both sides.

Kashmir is divided along the borders and the northern area alongside Pakistan referred to as ‘Azad Kashmir,’ falls under Pakistan’s jurisdiction.

Whereas the Indian side of Kashmir is bifurcated as Jammu and Kashmir state with a democratically elected Chief Minister Omar Abdullah under the governor N.N.Vohra.

Jammu and Kashmir with two state capitals Srinagar during summer and Jammu in winter has its origins tracing back to the first millennium when the entire valley was enriched primarily in Hinduism and governed by the people, a thriving republic.

Then the introduction of Buddhism came along, followed by the interim Islamic influence through Moghul emperors and again eventually ruled by the Dogras represented by the Hindu majority.

Maharaja Hari Singh, the most contemporary ruler (1895-1961) of the Kashmir valley sprawling from Jammu, Kashmir, Northern areas, Ladakh, Trans-Karakoram Tract and Aksai Chin had signed the instrument of accession to the Republic of India on October 26, 1947.

Upon Kashmir being attacked by Pakistani Armed Forces in 1947, soon after Pakistan and India’s freedom from British rule, Maharaja Hari Singh acceded the princely state of Kashmir in its entirety to the democratic India.

Maharaja Hari Singh is survived by his only heir His Highness DR. Karan Singh.

DR. Karan Singh held high profile cabinet positions during the former Indian Prime Minister Indira Gandhi’s term in office between 1970 and 1984. Besides being elected the President of the Province, then Governor of the State in 1964,

At present DR. Karan Singh is the titular Maharaja of the State of Jammu and Kashmir.

Today, Jammu and Kashmir demography reflects a Muslim majority, Hindus, Sikhs, Buddhists from Ladakh region and other ethnic groups from Northern India.

Regardless of the history, the bone of contention has been the state with the highly concentrated Muslim population should either become part of the Muslim nation i.e. Pakistan or allowed to seek autonomy from India and Pakistan.

Both scenarios do not bode well for the Kashmiris as they would be economically disadvantaged and politically vulnerable without the distinctive statehood and a stable Central government.

Moreover, Kashmir has other indigenous population such as Hindus, Buddhists, Sikhs…with formidable cultural and religious heritage going back to several centuries. The dispute settlement beckons the positive outcome for all rather than the selective course of action heeding to the national and international political rhetoric.

The militant groups’ activism originating from the Pakistan based Lashkar-e-Taiba misleading the separatist movement APHC, the All Parties Hurriyat Conference in the Indian State cannot be ignored.

Undeniably, the kamikaze policy is detrimental to the source and the parties affiliated to them.

If the notion is to create tension in the Indian state to destabilize the democratically elected government headed by the Chief Minister Omar Abdullah, such missions inevitably backfire leaving the majority population at the lawlessness mercy, thus exacerbating the political, economic and social environment.

The APHC and other separatist organizations seeking independence need not look farther for,

Pakistan in twenty first century is overwhelmed with internal turmoil triggered by ceaseless terrorism and the credible evidence against the Pakistan military as well as the intelligence agency’s affiliations to Taliban and terror networks keeps unfolding time and time again.

The democratic governments in Pakistan have been toppled and challenged since birth. The continued attempts only derail the economic progress for the country with incredible potential to compete in the global economy.

Pakistan is undermined by the defense sector focused on prolific arms trade. It is proved to be a major impediment in improving its relations with not only India but also Afghanistan and others in the region.

The intermittent diplomacy emerging between Pakistan and India including Afghanistan require perseverance in dialogue aimed at each other as allies not adversaries.

Although, the incumbent Pakistan government along with the United States has pursued the terror networks, the operation cannot be successful without Pakistan’s ISI and military officials’ true commitment.

Indian troop level maintained at half a million to safeguard the 10 million Kashmiri population has been the highlight of Pakistan’s complaint.

Pakistani government on its part is yet to address India’s legitimate request to eliminate radical terror groups – ominously Lashkar-e-Taiba, the Haqqani network and the likes, having been successful in the terrorist act against Indian civilians.

Even Pakistan’s cooperation has been dismal in extraditing the terror masterminds in the face of harsh realities.

It’s in the best interest of Pakistan to eradicate the contaminants polluting their soil and renew Pakistan’s image as a reliable partner in global war on terror.

Failing that people in Pakistan are held back from moving forward in the new millennium and stigmatized because of the various terrorist groups’ nefarious activities.

When comparing the economic and political conditions of ‘Azad Kashmir,’ under Pakistan governance with the Indian state Jammu and Kashmir, the citizens on the Indian side have better economic prospects and political stability barring the militant’s infiltration across the border and the Indian Security forces reaction to curb the instigation.

Poignantly, the advocacy on secessionism in relation to Kashmir from different corners ought to be analogized.

Those who favor Kashmir secession from the Union of Democratic India premise their decisions purely on the census data and disregard the dire consequences from it.

For instance, California is exceedingly populated by the once ‘minorities,’ projected to be the majority in the near future.

Similarly, France and other parts of Western Europe are dominant with immigrants especially a much higher Muslim population expected to grow exponentially by 2050.

The population ratio as the criterion for the secessionist demands on Kashmir sets a nonviable precedence with serious repercussions to India and the rest of the world.

Notwithstanding that India is the second largest Muslim nation surpassing Pakistan and other Islamic countries on the globe.

Therefore, Kashmir or any other state for that matter within India could not be isolated from the democratic union now or in the future.

Jammu & Kashmir for all the valid reasons have been represented by Muslim Chief Ministers duly elected by the people through a democratic process and are provided with the necessary support from the Central government under the remarkable leadership of Prime Minister Man Mohan Singh.

Any grievances towards the excessive security forces presence or the latest incidents involving them are to be resolved peacefully and effectively in a democratic setting.

In fact, the valuable suggestions from the Chief Minister of Jammu & Kashmir, Omar Abdullah is pragmatic and extremely hopeful.

The Chief Minister has made the following proposal during the Cabinet Committee on Security session:

“The CCS, while taking stock of the situation, also discussed the proposal of state Chief Minister Omar Abdullah for beginning an internal dialogue with all shades of opinion.

The state government had also sent a request for a policy to rehabilitate former militants who had served their jail sentence and were unemployed besides a comprehensive policy for those youths who were willing to return from Pakistan-occupied-Kashmir.

It may be mentioned that intelligence agencies had been reporting that the majority of stone pelters have been those who have been former militants at present unemployed.”

It’s clear from the deteriorating situation in Kashmir that the former militants and the youths behind the unrest could be deterred through economic solutions i.e. employment, government and private sector programs assisting youth participation in community projects; facilitate entrepreneurship – small businesses and self-sustenance modeled on urban development

Indian Central government has a responsibility to investigate the allegations against the security forces in the ongoing protest producing loss of lives.

Indian security force would be admirable as peace keepers and avoid measures leading to civilian deaths or physical harm.

The Kashmiris’ plight from all walks of life deserve the state and the Central government result-oriented actions targeting the political, economic and social problems with an assurance that Kashmir is and will always remain the integral part of secular India.

Kashmir harmony is paramount for the Indian sub-continent peace. The elements trying to sabotage the democratic system are destined for their own downfall in accordance with the end justifying the means.

Kashmir could achieve the long lasting peace and prosperity in the current democratic atmosphere ideal for new developments.

Good Luck! To Prime Minister Man Mohan Singh, Chief Minister Omar Abdullah, the cabinet ministers, APHC and the people of Kashmir in the amicable resolution of the conflict.

Thank you.

Human Tragedy

July 19, 2010

By Padmini Arhant

Condolences to the families mourning the loss of life from different tragic events.

The recent train crash in West Bengal, India with reportedly 61 people dead in the accident is regrettable.

In other incidents, terrorism taking toll on human life is the norm in certain parts of the world.

The bomb blasts in July 2010 alone has claimed many innocent lives –

Pakistan, Afghanistan, Iraq, Iran…in July 2010 is worthy of condemnation as often the civilians are the victims in the terror related violence.

Freedom along with social and economic opportunities would substantially deter the terror recruitment among the desolate youth population hired for committing horrendous crime against their fellow humans.

Evidently, the citizens in these regions unanimously favor the divestments from prolonged wars towards social and economic development.

Peaceful resolutions focused on economic progress would enormously benefit everyone involved in the global terrorism era.

Terror networks successfully engage the impoverished segment of the population under the pretext of improving their life and the lack of education among the terror recruits is a huge advantage to them.

Accordingly, the militants and the terror organizations regularly attack schools and the educational institutions to deprive the youth from proper education.

Investments in drones, bombs and sophisticated artillery thus far might have eliminated the crucial targets. However, terrorism never dissipates despite the relentless military intervention due to the underlying hindrances in human existence.

Besides participation in the governance through democratic process, the overwhelming majority in these nations seek basic requirements such as clean drinking water, healthy environment to live in modest conditions enabled by agriculture and industrial growth .

Unless these issues are addressed effectively which is not possible by a dysfunctional government, the terror networks will continue to exist as a parallel governing authority holding the people hostage to their violent agenda.

Empowering people with necessary economic and human rights is the best alternative to the military options that are increasingly alienating the local population from the Western interests.

Perhaps, the nations combating terrorism could consolidate their resources and aim to alleviate the suffering through peaceful means.

Where there’s a will, there’s a way.

Thank you.

Industrial and Environmental Disaster Victims Compensation

June 17, 2010

By Padmini Arhant

There appears to be a light at the end of the tunnel for the victims of the worst industrial and environmental disaster.

The energy company, BP’s agreement to compensate monetarily with $20 billion over three-year period for the Gulf Coast oil spill impact is a fair beginning.

It’s been set up without a cap and to be monitored by an independent administrator previously appointed to oversee the 9/11 families’ relief fund.

In fact, the urgency lies with the company’s daunting task to stop the gushing oil completely, otherwise ‘plug the hole.’

President Barack Obama’s initiative deserves credit for it enabled BP’s decision.

Now, it’s imperative not to proceed in the direction that has inherent risks with unsustainable loss of life and income to the communities along the coastal regions.

Abandoning offshore drilling in deep and shallow water is the ideal solution to prevent economic and environmental costs.

Some permanent damages to wild and marine life are incomparable for they exceed any likely benefits from oil exploration to attain energy independence, especially when there are absolute clean energy options available through solar, wind, hydropower, bio-fuel etc.

Similarly, the Bhopal victims’ plea for justice in the historic industrial negligence causing several thousand casualties and wreaking havoc in the surroundings with terminal illnesses, birth defects… making life impossible for the impoverished survivors exposed the long buried truth suspected in the failure to implicate the parent company, Union Carbide USA and its then CEO Mr. Warren Anderson.

As stated in the earlier blog post titled “Worst Industrial Catastrophe – Union Carbide / Dow Chemicals and Bhopal Victims of India,” published on June 12, 2010,

The deal between the parent company Union Carbide USA and the Indian government at the federal and state representation confirms the immunity granted to Union Carbide USA including the assurance to the then CEO’s safe departure prior to his arrival in India.

According to the latest reports, the US Envoy to India in 1984, Mr. Gordon Streeb, has come forward and disclosed the details in the agreement between the parent company Union Carbide USA and the Indian government at that time.

The international and Indian journalists, the primary witnesses at the site, corroborated the events leading to the unresolved dispute.

Further, the ex-CEO Mr. Warren Anderson concurred with the key elements in the Bhopal accident settlement during his recent interview.

Per the emerging reports, “the previous Indian government in a sweeping effort to westernize the status quo and transform the ‘socialist,’ economy to ‘capitalism,’ adopted appeasement strategies to lure foreign investments.

In that context, the Bhopal tragedy was an impediment to the measures due to the multinational corporation’s conspicuous mismanagement of the chemical plant.

Subsequently, the transaction materialized at the highest political and corporate level in the backdrop of the greatest industrial calamity.

Again, obstruction of justice through politics and prejudice is not territorial.

It’s an epidemic that has evolved into an unpleasant fact for the innocent deprived of free and fair judicial process.

Nevertheless, the incumbent Indian administration led by Prime Minister Manmohan Singh seemingly responding with the following appropriate actions:

A new institution called the “EGom,” – Empowered Group of Ministers have been designated with the responsibilities to address the Bhopal victims’ humanitarian needs by imposing a deadline i.e. June 24, 2010 to expedite the much awaited disaster aid.

Source: Indian News Media and the Indian Government Official Data.

Bhopal EGom”s Tall Order:

Work out enhanced compensation package for the survivors of the Bhopal gas explosion.

Provide relief and rehabilitation to the victims.

Determine ways to decontaminate the site not precluding soil and ground water testing to ensure safe living conditions.

Rigorous regulations on industrial mishaps with liabilities directly transferred to the corporations in violation.

Last but not the least, the Government contemplating Mr. Warren Anderson’s extradition request.

The diligence demonstrated by Prime Minister Manmohan Singh and the Congress Party Leader Sonia Gandhi is praiseworthy.

However, the challenge remains in implementing the executive order with none or minimal bureaucracy that often delays the anticipated results.

The victims have endured enormous suffering and any procrastination would exacerbate their plight.

Notwithstanding the government obligations since they are the fund recipient in the Bhopal dispute.

Regarding Mr. Warren Anderson’s extradition – considering the individual’s frail health and age (90+ years), a televised formal apology to the Bhopal victims would be morally and ethically sound, rather than subjecting the elderly defendant to legal proceedings.

Although, the affected citizens’ pain and agony over these years has been excruciating, their forgiveness of those incarcerated in the horrific incident could heal the ordeal experienced by them.

For human spirit is enriched through compassion.

It’s a long journey for the disaster victims in the east and the west, but there is hope with the leaderships on both sides striving hard to end the misery.

Thank you.

Worst Industrial Catastrophe – Union Carbide / Dow Chemicals and Bhopal Victims of India

June 12, 2010

By Padmini Arhant

On June 7, 2010, the verdict on the worst industrial gas leak in 1984, Bhopal, India was delivered by the state’s local court.

According to the several reports:

The ruling convicted the seven officials in senior management along with the employees of the former Union Carbide India Limited (UCIL), the then subsidiary of the Union Carbide, USA with CEO Warren Anderson at that time.

Conviction included two years jail sentence and Rupees 100,000($2,100, €1,800) in fine.

Understandably, the judgment aroused sentiments among the victims’ devastated families and the survivors.

The NGO’s and other organizations representing the victims welcomed the much awaited process brought to national and international attention after pursuing the legal course for more than twenty five years.

However, they expressed huge disappointment in the limited sentencing and the exemption to the then Parent Company, Union Carbide CEO Warren Anderson.

India’s request for the CEO’s extradition to face trial was rejected in June 2004 by the United States.

Mr. Warren Anderson was the CEO of Union Carbide U.S.A during the industrial disaster in 1984 and served the corporation until 1986.

Subsequently, Union Carbide in their statement delineated themselves from the gross industrial negligence that claimed scores of lives and continue to affect more, the living and the yet to be born evidenced in the birth defects as well as other illnesses diagnosed thus far.

Union Carbide U.S.A transferred all liabilities pertaining to Bhopal incident over to its then fully owned subsidiary Union Carbide India Limited, while accepting the revenues and profits from the offshore operation. Effectively reflected in the multinational corporation CEO’s income, stock options and bonuses.

Moreover, the facts supporting the systemic operational facility discrimination between the U.S site and the Bhopal plant was disregarded in the entire proceedings.

Source: Wikipedia.org titled Warren Anderson (Chairman)

“Greenpeace asserts that as the Union Carbide CEO, Anderson knew about a 1982 safety audit of the Bhopal plant, which identified 30 major hazards and that they were not fixed in Bhopal but were fixed at the company’s identical plant in the US.

Union Carbide asserts that the Bhopal plant addressed all of the identified issues well before the December 1984 gas leak and that none of them had anything to do with the disaster.

Greenpeace claims that neglecting these hazards in Bhopal caused the explosion.

Others, such as the former police chief Swaraj Puri, who was injured in the Bhopal disaster, asserts that Mr. Anderson must have known about the danger of the plant because an employee had died there a year before the disaster.”

Statistics on the human tragedy from this major industrial catastrophe are as follows:

Source: Indian Supreme Court, Madhya Pradesh government, Indian Council of Medical Research

Initial deaths – more than 3,000 – official toll

Unofficial initial toll: 7,000-8,000

Total deaths to date: over 15,000

Number affected: Nearly 600,000

Compensation: Union Carbide pays $470m in 1989

Unfortunately, for the survivors and the victims’ families, the issue is not restricted to the selective indictment or the mild sentencing on a monumental management failure;

It’s rather an uphill battle to investigate the matter because of the high profile corporate and political power implicated in the horrific crime, especially with more information presented through visual content in the Indian media that confirms,

The “most wanted” CEO, Warren Anderson escorted in an Indian state government vehicle for safe departure from the Indian shores upon being released on bail after his arrest in December 7, 1984.

Mr. Anderson noted as the “chief defendant” in the trial from the beginning was excluded in the recent hearing outcome.

Per Wikipedia.org:

Later, “the arrest warrant issued on July 31, 2009 by the Chief Judicial Magistrate, Prakash Mohan Tiwari, Bhopal, India rendered ineffective due to the U.S. declining the extradition treaty, citing a lack of evidence.”

It bears resemblance to the 9/11 tragedy when the terror mastermind, Osama Bin Laden’s family were reportedly allowed secure passage from the United States in 2001.

The dangers of politics and prejudice playing dominant role in the judicial system, often deprives the innocent from obtaining justice even in the democratic society.

Such obstruction of justice through political influence and camouflage from the top bottom makes a mockery of the judicial system in a democracy.

It’s increasingly prevalent in the trials that could potentially expose the authorities in bad light.

No political system is an exception to the concept.

Besides, the news corps media being the primary voice for democracy have a journalistic responsibility to decipher the intricacies behind the funds exchange between Union Carbide USA and the Indian government that received the disclosed $470 million compensation with or without any stipulation.

Although, the monetary compensation is not proportionate to the suffering and damages sustained by the victims,

It’s still important to ascertain the amount actually received (if any) by the affected individuals in the prolonged dispute and address the status quo adequately.

Setting the political priorities aside, the dire situation beckons the Indian and the U.S. entities to view the Bhopal victims’ plight as a humanitarian calamity and exemplify requiring transnational corporations to adhere to universal environmental and ethical standards in the globalization era.

Justice denied to the innocent is Justice betrayed. For actions and decisions by all are judged accordingly.

Bhopal victims deserve better considering the long ordeal endured by them.

Providing medical assistance, toxin free living conditions with continuous monitoring to eliminate the persisting health hazards are the minimal needs for survival.

Enforcing strict industrial safety codes and regulations would protect workers from serious occupational injuries.

In addition, imposing liability on the corporations regardless of statehood for human and environmental harm is necessary to prevent negligence and evading financial obligation.

Whether it is Bhopal, India or the Gulf Coast in the United States, the communities pay the price in the deadly chemical release and oil gusher.

Perhaps, the bilateral solution to the problem rests with the Indian and U.S authorities to do right by shifting the burden of proof from the victims to those connected to the horrendous casualty in the Bhopal gas explosion.

Thank you.
