India –  BJP Government Objection to UNHRC Plea on CAA, NPR & NRC

Prime Minister Narendra Modi government and the state run media objection to UNHRC joining other local petitioners on the controversial #CAA, #NPR and #NRC in the Indian Supreme Court calling out UNHRC participation as foreign body intervention in India’s internal affair and further claiming that such activity is violation of India’s sovereignty deserves attention.

India’s position might be valid upon Indian government strict adherence to Indian constitution and democratic rule of law barring any form of discrimination and prejudice that the legislated act #CAA, #NPR and #NRC proved to be in the testing ground viz. the north eastern state, Assam.

Assam citizens requested for protection of the natives political, economic and social rights and the indigenous culture that are on the brink of dissipation due to migrants from adjacent West Bengal and population influx from Bangladesh post 1971 war between India and Pakistan.

Instead, Assamese problem exacerbated with natives and locals placement in detention centers on the basis of convoluted NRC and CAA diversion from initial approximately 33,000 immigrants to now 19% of population of which 12% are Hindus and Delhi Central government defined Hindu denominations viz. Sikhs, Buddhists, Jains, Parsis and Christians leaving the remaining 7% muslims as illegals per PM Narendra Modi’ government’s declaration.

The foreign tribunal set up in Assam to filter the qualified against the non-qualified in the citizenship criteria already split internally with the resignation of a tribunal member dissenting on the corruption and lack of credibility in the process that apparently allowed applicants with forged documents bribing the administration officials while declining citizens with proper documents and papers on them.

The long established second and third generation citizens in Assam having been affected by NRC flaws could not even receive any justice in the State High Court interpreting the New Delhi government law as final.

As a result, the Assamese natives are being relocated from their place of residence to BJP government assigned detention centers with reports of some deaths in some facility from the inadequate accommodation requirements.

The cases in reference are as pointed out earlier on this site – the former President of India Fakhruddin Ali Ahmed’s family isolated as non-citizens of India.

Similarly the former war veteran Army Major Mohammed Sanaullah, a decorated Indian Army Officer having served Indian defense force for over thirty years and honored with Presidential medal for his bravery in Kargil war between India and Pakistan that almost led to nuclear meltdown in 1999 only to be now denigrated as a foreigner and dispatched to detention center could not be an inadvertent mistake. The Army officer Mohammed Sanaullah had to prove his citizenship in the court of law at his personal expense.

Needless to say ordinary citizens living hand to mouth in a distressed economy are not in a position to deal with such challenges evidently associated with #CAA, #NPR and #NRC.

These are the ramifications from #CAA, #NPR and #NRC that are falsely propagated as no brainer in implementation harming none anywhere in India despite the unraveling of the unnecessary government agenda.

The intriguing aspect of this #CAA in particular is the government plan to naturalize minority Hindus and Hindu category as outlined above from Pakistan, Afghanistan and Bangladesh living in non-residential status in Assam legislated in Parliament with an amendment to the existing citizenship act. When the government could have granted asylum to all those members including muslims upon every one of them satisfying the standard criteria and importantly without criminal record.

PM Narendra Modi, HM Amit Shah and their surrogates in media and those representing the government in media discussions on this topic defend #CAA, #NPR and #NRC as laws that target none even though muslims are specifically segregated from this group for citizenship approval.

Furthermore, what was the need for  PM Narendra Modi government to amend the citizenship act for #CAA?

Again, when the matter could have been addressed without dragging the nation into quagmire producing protests followed by BJP government ministers and members unleashed hate speeches and inflammatory recommendations that consumed more than 47 innocent lives in the latest horrific Delhi violence and set North East Delhi on fire.

Obviously, these events suffice to summarize that are more to these laws that meets the eye and the government confirmation in this regard with no political will to resolve the issues amicably prolong the contentious citizenship saga.

Now on the issue of UNHRC accused of meddling in India’s domestic propositions.

The synonymous action from India, in fact  Prime Minister Narendra Modi and his government indulgence in neighboring Nepal, an independent sovereign state with democratically elected government passing a unanimous constitutional amendment in Parliament on Nepal’s Hindu status to secular state was condemned by PM Narendra Modi, his government and BJP in unison.

They did not stop at reprimanding Nepal’s leadership and opposition alike for this transition from Hindu state to secularism or pluralist status.

PM Narendra Modi unilaterally imposed economic sanctions against the economically struggling small nation like Nepal subjecting children, women, youth and elderly to extreme difficulties depriving them of food, medicines and basic essentials leading to casualties from that economic blockade lasting several months in 2015.

Perhaps at that time, PM Narendra Modi and cohorts singing in chorus now could have realized that India and Indian government had no business to chide Nepal nor possessed any right to intervene in Nepal’s sovereign decision let alone execute drastic trade embargo on Nepal.

Politics selective amnesia is well known and Indian critics on UNHRC sharing concerns as interventional fail to acknowledge own record fitting the profile.

India’s interference in 2015 was intrusive especially concerning Nepal’s admirable measure becoming inclusive in recognition of all citizens and diverse background in the country unlike India on the reverse course.

Often such examples serve as poignant moments in political history striving to safeguard democracy and constitutional rights of all citizens rejecting bias and marginalization of any segments in society.

Unfortunately, India is driven in the opposite direction in defiance of democracy, constitution and humanitarian law benefitting none at the end.

Indian citizenry consciousness and mass awakening to this effect pertinent to avert undesirable destination reflected in status quo.

The latest development on CAA, NPR and NRC resulting in at least twenty two casualties with majority of muslims against CAA thus far engaged in peaceful non-violent assembly until BJP minister Kapil Mishra along with BJP members Anurag Thakur and Parvesh Verma instigated violence claiming many unarmed innocent civilian lives and a law enforcement personnel life in North East Delhi is deeply regrettable.

The Central government unnecessary involvement in the outreach to Indians of specific religions barring Islam in Pakistan, Afghanistan and Bangladesh while subjecting muslims and so-called lower caste Hindus as well as others to bloodshed in India clarifies the present government under PM Narendra Modi and HM Amit Shah repeating Gujarat history in New Delhi conforming to the adage ‘old habits die hard.’

Justice Muralidhar presiding the hearing on the recent violence reaches the verdict to bring BJP minister Kapil Mishra and BJP accomplices Anurag Thakur and Parvesh Verma to justice for inciting violence and letting mob activities producing the unfortunate outcome.

Not surprisingly, the home minister Amit Shah promptly transfers justice Muralidhar from Delhi High Court to northern state Punjab.

Amit Shah’s egregious decision post midnight obstructing justice to protect BJP offenders is nothing new considering his legacy in this regard viz. the Indian judge Brijgopal Harkishan Loya who served in a special court which deals with matters relating to the Central Bureau of Investigation. Justice Loya was presiding over the Sohrabuddin Sheikh case directly linked to Amit Shah.

Justice Loya delivered judgement against Amit Shah in 2002 Gujarat violence. Justice Loya  was murdered upon declining bribe and other incentives to drop the judgement against Amit Shah at that time.

Narendra Modi and Amit Shah’s political career as stated earlier is marred with violence, communal riots, mob lynching, murder of members in judiciary, investigating agency such as CBI that happened lately, BJP Lok Sabha member of parliament Gopinath Munde murder in June 2014 covered up as freak road accident due to disagreements in policy within party, gunning down of journalist and writer Gauri Lankesh in Bangalore with PM Narendra Modi cheering the incident by following the assassin’s twitter, unlawful imprisonment of former IPS officer Sanjiv Bhatt from Gujarat are chronicles in Narendra Modi and Amit Shah run state and central government.

Sanjiv Bhatt is a former Indian Police Service officer from Gujarat. Sanjiv Bhatt filed an affidavit in the Indian Supreme Court against then Chief Minister Narendra Modi heading the Government of Gujarat for his complicity in communal violence leading to killings of citizens mostly muslims such as women and children burned alive in some instances as the reports surfaced later. 

The imprisonment of the former Senior police officer Sanjiv Bhatt is not an isolated incident. Upon becoming Prime Minister, Narendra Modi has selectively isolated human rights activist and environmentalist, the United States born citizen Mrs. Sudha Bharadwaj, a legal attorney in her own rights among several other human rights advocates, journalists and authors branded urban naxals holding them in indefinite unlawful unconstitutional imprisonment denying them due process viz. habeas corpus to prove their innocence are mere examples in the series of violations and abuse of power by Narendra Modi and Amit Shah thus far.

Notwithstanding the harassment and aggressive tactics against former Indian Army personnel – Ex -Border Security Force Officer Tej Bahadur Yadav forcing the soldier’s twenty one years old son to commit suicide from the unbearable constant Modi government and media intimidation of the family. The Ex-BSF officer Tej Bahadhur Yadav upon rejecting Narendra Modi and Amit Shah’s bribe of $500 million  to drop out of the 2019 national election against Narendra Modi in Varanasi fraudulently disqualified the Indian soldier’s candidacy in May 2019.

Furthermore, Narendra Modi and Amit Shah’s political strategy deploying devious means such as bribery or threats to conduct raid against members of opposition political parties in an effort to wipe opposition in the political system is the norm.

Besides, anyone in any institution heading probe against the incumbent administration and government i.e. PM Narendra Modi and Amit Shah’s numerous corruption dealings and criminal activities are either lured with cash and foreign posts or eliminated from their positions including murder of such individuals for non-cooperation.

Narendra Modi’s rise to political status at India’s detriment aptly attributed to United States former so-called democrat President Barack Obama having come to Narendra Modi’s rescue misusing Presidential power preventing the trial against Narendra Modi on Gujarat violence in New York Court that summoned then Chief Minister Narendra Modi upon his arrival at JFK, New York was just the beginning.

Now the successor United States President Donald Trump glorifying Narendra Modi’s profile substantiates United States stance on human rights, democracy, constitution and individual liberty that obviously flouted time and time again regardless of political representation in the United States proudly declared the beacon of democracy.

United States and western allies together with others in the multinational corporate run global politics, fostering authoritarian, dictatorial regimes is the tradition. History is testament to the fact in every part of the world predominantly to serve vested interests much to the destruction of constitutional based democratic governance.

Although, United States having earlier rightfully not granting travel visa to Narendra Modi related to Gujarat violence and scores of innocent deaths in 2002 only to be reversed by the so-called democrat President Barack Obama and lately Republican incumbent President Donald Trump slighting recent events confirms United States government priority or the lack thereof to human rights and the fundamentals of democracy.

Indian government leaderships under Prime Minister Narendra Modi and Home Minister Amit Shah subversion of democracy and extreme violations in the abuse of power leading to incessant violence, innocent deaths, unnecessary tensions and unrest in the country appropriately calls for the resignation of Prime Minister Narendra Modi and Home Minister Amit Shah sparing vulnerable segments viz. muslims, so-called Dalits and other targeted demography from continuous persecution and religion caste based mob killings that has become the way of life in addition to saving democracy as well as the distressed economy is paramount.

India’s secular diverse culture and hard fought independence in adherence to constitution protected equal rights, opportunity and respect for all barring any form of prejudice exerting caste, religion and other basis could no longer be dismissed as witnessed in the ongoing political, social and economic precipice.

I convey my sincere condolences to the families and students who have suffered enormously in the recent violence and survivors who have lost their loved ones in the senseless government actions on CAA, NPR and NRC .

I also urge the vast number of Indians protesting against CAA, NPR and NRC to maintain absolute peaceful, non-violent, civil decorum and disposition resisting any form of provocation and instigation from the government and their representative groups harming collectively as there are no winners in violence.

Importantly, the CAA, NPR and NRC protesters engagement through direct dialogue and discourse on this matter is pertinent and would avoid such confrontations with groups likely to infuse altercation.

There are also ways to submit your grievances and share your concerns through social media provided access available to exercise the basic right unlike the government intervention in Kashmir blocking communication and internet access for longer period prolonging until now over there.

The resolution to the current situation in India is for the BJP government to repeal CAA and abandon the unconstitutional undemocratic NPR, NRC and resume established census method safeguarding citizens rights and privacy.

As for the population as second and third generation residents with no documents and not having criminal records threatening any citizen’s safety and national security should be granted amnesty or asylum again discarding religion based criteria treating all as nothing but humans and Indians in statehood and citizenship.

The government’s failure to resolve the issue in the above manner i.e. revoking CAA and adopting democratic practice on national census leaves the nation and the ones inevitably to be affected viz. significant percentage of all Indians not just muslim Indians in government obstinacy on citizenship rights with no choice but seek removal of leaderships from power.

Prime Minister Narendra Modi and Home Minister Amit Shah stepping down from office would demonstrate Indian democracy’s strength and legitimacy.

Prime Minister Narendra Modi headed government policy on CAA, NPR and NRC is unprecedented undemocratic means aimed at disenfranchisement of large swath of population representing Hindu majority besides Muslims and other minorities in the country.

BJP spokespersons and surrogates making rounds in all forms of media and press to defend indefensible citizenship act discarding constitution is a desperate effort to impose draconian measure stripping vast number of Indians their citizenship under the guise of national registration.

Prime Minister Narendra Modi administration having miserably failed to address ailing economy burdened with high unemployment, inflation and gloomy business environment ignoring tragedies involving suicides among educated and skilled unemployed youth in the urban areas and distressed farmers in rural India is rather unfortunate. Instead PM Narendra Modi adopting diversionary tactics to deprive Indians statehood and citizenry clarify BJP agenda behind polarization politics.

PM Narendra Modi’s Hindutva ideology in compliance with RSS fundamentalism endanger Indian democracy.

The mass protests nationwide in the past three months denouncing the reprehensible CAA, NPR and NRC is of least concern to PM Narendra Modi and his BJP government that in itself explains the serious threat to Indian democratic system.  Any genuine democratic leadership would heed citizens call to scrap CAA, NPR and NRC as it is premised on government’s selective criteria to maintain voting block while isolating significant population from voting rights and importantly removing their citizenship status despite many of them being second and third generation Indians in the country.

PM Narendra Modi governance style thus far proved to be anti-constitutional and anti-democratic upon reviewing series of events where all institutions beginning with the election commission, judiciary not barring the highest court on land i.e. the Supreme Court of India, Central Reserve Bank, investigating agencies like Central Bureau of Investigation (CBI) and Enforcement Directorate to Income tax department are misused to political and personal advantage in order to remain in power.

The systemic abuse of power is the norm under PM Narendra Modi continuing the legacy from Gujarat as Chief Minister undermining democratic principles with the record on gross human rights violations instigating communal violence and riots resulting in deaths of scores of innocent children, women and men in Muslim and Hindu communities in the state.

PM Narendra Modi performing to the scripted role directed by internal organization RSS and external foreign forces transformed the highest office of Prime Ministership into showmanship, the trend having originated in the United States 2008 Presidential election and prolonged post election until date to beguile captive audience only to be disillusioned sooner than later experienced in both democracies time and time again hard to escape observant’s attention.

As for BJP media representatives and regional allies in government claims that CAA, NPR and NRC would not affect Indian Muslims and other Indian citizens despite several incidents confirming otherwise clearly demonstrates the authorities underestimating human intelligence and citizens understanding of the devious plan to marginalize and alienate overwhelming majority in the country.

Since politics characterized as presumptuous and mendacious in nature rejecting ground reality much to own embarrassment and detriment is least surprising. The former Indian President Fakhruddin Ali Ahmed’s family having been the victims of citizenship elimination process along with former Army Major and Kargil war veteran in Assam Mohammed Sana Ullah, who had won a President’s medal for his thirty years of service to his country India, dispatched to a detention center as a foreigner based on his religion and Muslim hood is the kind of treatment the protesters across India fear from this dreadful CAA, NPR and NRC under PM Narendra Modi’s premiership.

Furthermore, the BJP alliances in regional states falsely projecting the government as the authority committed to their word when Prime Minister Narendra Modi has defaulted on numerous pledges and promises to the nation such as in the wake of disastrous demonetization the government offer to deposit 15 lakhs i.e. 1,500,000 rupees in each Indian citizen’s bank account that obviously never materialized until today and contrarily bankrupted ordinary citizens including 165 or more deaths from this particular debacle. Similarly, electoral gimmick on millions of jobs creation ended in evaporation in the first and second term of PM Narendra Modi’s terms in office are mere examples of consistent renege on government obligation to the nation at large.

Tamil Nadu ruling government ADMK as BJP’s partner insisting that people in the Southern state should give the latter the benefit of the doubt on CAA, NPR and NRC neglecting above cited realities is yet again politics prioritizing own political gains over citizens’ identity situation. Besides, the ADMK members complicity with their former Chief Minister Jayalalitha who championed the cause in converting Tamil Nadu towards alcoholism among many other nefarious activities and corruption scandals expecting Tamil Nadu population to believe the local government to protect them is indeed a far cry.

No matter how this egregious decision to marginalize disproportionate Indian population in the latest CAA, NPR and NRC is circumvented by Prime Minister Narendra Modi and regional allies, the dangerous course is ominous to those predicting a favorable outcome. The ill-conceived policy would further promote corruption prompting government employees and other recruits to demand bribes from anxious and vulnerable citizens unable to produce many documents required in the citizenship verification exercise. The forged documents with bribes appearing in the arduous data compilation is imminent only compounding the complex citizenship detection methodology.

Not to mention the unwanted chaos and turbulence in society with the families and individuals inability to meet the elaborate document submission to prove their citizenship status.

Prime Minister Narendra Modi’s government withdrawal of CAA, NPR and NRC is no longer an option but a necessity to prevent the nation from inevitable turmoil due to incomprehensible procedure detouring the established census act safeguarding citizens’ rights and privacy.

The lack of wisdom and pragmatism in such political scheme is prominent.

Nonetheless, at no point in time any government and forces behind them should take people and their will for granted witnessed in the ongoing relentless struggle against CAA, NPR and NRC in India.

While Indian government and administration under Prime Minister Narendra Modi and home minister Amit Shah are dedicated to contentious Citizenship Amendment Act (CAA), National Registry Citizens (NRC) and now citing long existing National population registry (NPR) (census) to maneuver the embattled Hindutva ideology isolating specific demography in an effort to allocate vote banks,

The most favored corporate families viz Mukesh Ambani, Anil Ambani and Gautam Adhani among others in economic sector essentially run politics, economy, judiciary and media.

Not surprisingly, Reliance industries and Jio Telecom company CEO Mukesh Ambani reportedly per bloomberg.com adds $17 billion dollars to personal net worth in 2019 leading to individual total net worth at $61 billion claiming the status as Asia’s richest individual.

The corporate monopoly defiantly in gross violation of anti-trust and capitalist economy characteristics such as fair opportunity to all major and minor businesses to compete effectively enabling market determined factors to yield returns and profitability across economy rather than sole advantage to particular corporate group or family.

Furthermore, market economy benefitting consumers in terms of choices and options in quality, price and service is phased out in the prevalent economic environment.

The government pledge to protect selective corporate families interest at the vast majority expense where nearly a billion population is forced into record unemployment, inflation and sluggish economic growth arguably embarked on deflecting public attention from burgeoning economic strife alongside the meteoric rise of Mukesh Ambani and Ambani industries questionably held above law and exempt from transparency and accountability on tax compliance and various rules and regulations otherwise applicable to regular ordinary business entrepreneurs and retail merchants in the economy.

Indian population especially the educated and skilled youth in formal and informal sectors confronted with dismal economic and career prospects justifiably frustrated about status quo.

Indian government’s misplaced priority in enforcing laws and amendments on citizenship act causing unnecessary tension and anxiety primarily to distract citizens focus from chosen corporate expansion amassing personal wealth should be a grave concern for significant population struggling to make ends meet and overwhelming segments in abject poverty.

Corporate run politics and governments are not to be expected to bridge the gap between the haves and have nots when the system is solidified in quid pro quo for exclusive benefits and privilege.

Indian government and politics together bear responsibility for the ever increasing economic disparity and social inequality in society.

Indian citizens dealing with serious economic crises legitimately require to seek government action on reviving economy and immediate end to partisan politics premised on religion, caste and communal polarization.

Unless the situation and issues are addressed reversing the conditions, those reaping the harvest too would sooner than later experience the free fall of economy currently heading in the undesirable direction.

The prosperity of any or few depriving the rest from basic existence and survival is unsustainable resulting in inevitable negative outcome.

People power proved formidable in resisting unconventional practice and divisive politics.
